These Terms and Conditions ("Terms") govern access to and use of Famotive, a family productivity and chore-management application (the "Service" or "App") provided by Tactician Studios LLC ("Tactician Studios," "we," "us," or "our"), a company located in Kansas City, Missouri. By creating an account, downloading, or using Famotive, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Famotive is intended for use by families. The primary account holder ("Parent") must be at least 18 years old and have the legal authority to create and manage child profiles within the family account. Children access Famotive only through a child profile created and supervised by a Parent — children do not independently register for or maintain a Famotive account.
Parents are responsible for: (a) all activity that occurs under the family account, including each child profile; (b) maintaining the confidentiality of account credentials; and (c) ensuring that any information entered about a child is accurate and that the Parent has the authority to provide it.
Famotive allows Parents to create, assign, and manage household chores and recurring tasks, and to review and approve tasks completed by children. Children complete assigned chores to earn experience points ("XP"), achievements, and rewards, and to progress toward family goals, all within the app's gamified experience. Features may be added, changed, or removed over time, and we may introduce optional paid features or subscriptions.
Tactician Studios is not responsible for disputes between a Parent and child, or between members of a household, regarding chores, approvals, or rewards.

We reserve the right to modify, reset, or discontinue any virtual item, XP system, or reward mechanic at any time, including in connection with updates to the Service.
Certain features may be offered on a paid or subscription basis. If you purchase a subscription, you authorize us (or our payment processor) to charge the applicable fees to your chosen payment method on a recurring basis until you cancel. Prices, billing cycles, and cancellation terms will be disclosed at the time of purchase and, where applicable, are also governed by the terms of the app store (Apple App Store or Google Play) through which you subscribed. Fees are non-refundable except as required by law or as expressly stated at the time of purchase.
Famotive, including its name, logo, design, software, and all related content, is owned by Tactician Studios LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial, household use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
Famotive may in the future offer optional integrations with third-party platforms, such as gaming or reward services. Any such integration will be optional, will require your affirmative consent, and will be subject to the applicable third party's own terms and privacy practices, which we encourage you to review. We are not responsible for the content, policies, or practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. FAMOTIVE IS A PRODUCTIVITY AND MOTIVATION TOOL AND IS NOT A SUBSTITUTE FOR PARENTAL SUPERVISION, JUDGMENT, OR RESPONSIBILITY FOR A CHILD'S WELL-BEING, SAFETY, OR DEVELOPMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, TACTICIAN STUDIOS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50).
You may stop using the Service and delete your account at any time through account settings or by contacting us. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, misused the Service, or if we discontinue the Service. Upon termination, your right to use the Service will immediately cease.
We may modify these Terms from time to time. If we make material changes, we will notify Parents by email or in-app notice before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Jackson County, Missouri, and you consent to personal jurisdiction in those courts.
